JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Nawanagar P.S. Case No. 37 of 2017 instituted for the offence under Sections 366A/34 of the Indian Penal Code.
It is alleged in the written report that minor daughter of the informant, aged about 15 years, had gone to High School Kesath to deposit practical copy of the matriculation examination and she did not return to the house. The informant learnt from Kamlesh Paswan and Mithailal Kamkar that his daughter was seen going with Dheeraj Kumar (petitioner) and other accused person. Learned counsel for the petitioner has pointed out the statement of Kamlesh Paswan and Mithailal Kamkar which were recorded in paragraphs-9 and 10 of the case diary wherein it is
Patna High Court Cr.Misc. No.29096 of 2017 (3) dt.19-07-2017 2/2 stated that they have seen the petitioner along with other accused persons taking the daughter of the informant. As per written report, age of the victim girl is 15 years and she is still traceless.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
