This is an appeal under section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, (hereinafter in short referred to as the 'SC/ST Act') against the refusal of prayer for bail vide order dated 04.12.2021, passed by learned Exclusive Special Judge (SC/ST Act), Gaya in connection with Kotwali P.S. Case No. 410 of 2021, registered under Sections 302, 337, 338, 427, 504, 506, 120B/34 of the IPC and 3(2) (va) of SC/ST Act.
Appellants are said to have abused and assaulted the uncle of the informant.
Patna High Court CR. APP (SJ) No.63 of 2022(2) dt.19-05-2022 2/2 It is submitted by learned counsel for the appellants that the appellants are innocent and have been falsely implicated int his case. There is general and omnibus allegation levelled against the appellants. Appellants are the lady. He further submits that appellants have no criminal antecedent as stated in para-3 of this appeal and they are languishing in judicial custody since 31.08.2021.
Learned Spl. PP for the State and respondent no. 2 opposes the prayer for bail.
Considering the facts and circumstances of the case, let the above named appellants, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (SC/ST Act), Gaya in connection with Kotwali P.S. Case No. 410 of 2021. Accordingly, the impugned order is set aside and the appeal is allowed.
