Apprehending his arrest in connection with Chakai P.S. Case No. 26 of 2017 registered for the offences under Section 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.

After some arguments, learned counsel for the petitioner has sought leave to withdraw the present application in order to surrender before the court below and seek bail in the

Patna High Court Cr.Misc. No.29074 of 2017 (2) dt.20-07-2017 2 / 2 light of the observations and directions made in the order dated 07.07.2017 passed by this Court in the matter of Ashok Sahani Vs. State of Bihar (Cr. Misc. No. 26109 of 2017). Leave is granted.

The application is disposed of as withdrawn.
