The petitioner seeks bail in Murliganj P.S. Case No. 134/2017, registered under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2016 As per the prosecution case, two co-accused persons were apprehended with two bottles each of 750 ML Royal Stag Classic Whisky were recovered and apprehended persons disclosed their name as Bipin Mandal (petitioner) and co-accused Kunal Kumar.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and has been falsely implicated in this case. It is also

Patna High Court Cr.Misc. No.28889 of 2017 (2) dt.03-07-2017 2/2 submitted that there is general and omnibus allegation against the petitioner. The petitioner has been languishing in custody since 09.05.2017.

Considering the facts aforesaid, the above named petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura in connection with Murliganj P.S. Case No. 134 of 2017.
