The petitioners seek regular bail in connection with Excise Case No. 104 of 2017 arising out of Chapokhari P.S. Case No. 42 of 2017, registered for the offence punishable under Sections 30(d)/37(a) of the Bihar Excise Amendment Act, 2016. The accusation against the petitioners is regarding possession of Mahuwa Pas and upon recovery of the same by the police, the petitioners were apprehended.
It is the submission of the learned counsel for the petitioners that the petitioners have clean antecedent and they are in custody since 9.3.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular
Patna High Court Cr.Misc. No.29029 of 2017 (2) dt.01-07-2017 2/2 bail.
Accordingly, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned IVth A.D.J., Bhojpur, Ara in connection with Excise Case No. 104 of 2017 arising out of Charpokhari P.S. Case No. 42 of 2017.
