2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 319(2), 318(4), 338, 336(3), 340(1), 61(2) and 3(5) of B.N.S.

3. The case of the prosecution is that the petitioner has attempted to enter into physical examination in place of one Vikash Yadav. From perusal of the FIR, it transpires that from the possession of this petitioner, two aadhaar cards were recovered and on both the aadhaar cards, his photographs were there.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the

No.61764 of 2025(2) dt.08-09-2025 2/2 petitioner has submitted that the only allegation against him is that he has appeared for physical examination in place of Vikash Yadav and from there, he was arrested. He could not succeed in cheating rather he has only made an attempt. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 18.06.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Katihar Nagar P.S. Case No. 596 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar.
