This application for grant of regular bail arises out of Ladaniya P.S. Case No.264 of 2022 registered for the offence punishable under Sections 332, 353, 302, 272, 273/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition & Excise Act.

As per the F.I.R. after an accident was caused by a motorcycle, one Scorpio vehicle hit the deceased. 4.

From the manner of the occurrence, it appears that this is a case of accident and not a case of homicide. The petitioner is in custody since 07.08.2023. Some of the accused persons namely, Laxman Yadav @ Laxman Kumar Yadav and Bijay Kumar Yadav @ Vijay Kumar Yadav

Patna High Court CR. MISC. No.66894 of 2023(3) dt.06-12-2023 2/2 have been granted bail by this Court vide orders dated 16.10.2023 passed in Criminal Miscellaneous Nos.66841 of 2023 and 66834 of 2023.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 2nd -cum-Special Judge, Excise Act, Madhubani, in connection with Ladaniya P.S. Case No. 264 of 2022.

This is also subject to the condition that the petitioner shall mark his presence in Ladaniya Police Station, District- Madhubani on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
