2. The petitioner has preferred this application for grant of regular bail in connection with Katihar Nagar P.S. Case No. 593 of 2025 dated 16.06.2025 registered for the offences punishable u/ss 319(2), 318(4), 338, 336(3), 340(1), 61(2) read with section 3(5) of the BNS.

3. As per the prosecution case, the co-accused Pravin Kumar impersonated Kumar Abhisekh (petitioner) and made an attempt to appear in his place for taking physical capability test but could not succeed and was apprehended by police.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.64170 of 2025(2) dt.13-10-2025 2/2 this case. The petitioner has no concern with the said occurrence. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 10.09.2025 passed in Cr. Misc. No. 61215 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Katihar Nagar P.S. Case No. 593 of 2025.

7. The application stands allowed.
