The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basis accusation is of torture for nonfulfillment of dowry demand. The matter was adjourned on several occasions for allowing the parties to reconcile the issue. I.A. No. 645 of 2016 has been filed to the effect that both sides decided to part ways of payment of one time settlement amount of Rs. 1,40,000/-.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.21978 of 2015 (11) dt.07-04-2016 petitioner that draft of Rs. 1,40,000/- drawn of Punjab National Bank, Branch Sijhauri (Jamui) dated 05.03.2016 has been handed over to the counsel appearing for the informant.
Learned counsel for the informant submits that the aforesaid I.A. has been affidavited by both the sides. He further submits that he has received the draft and has opened an account in Bihar Gramin Bank bearing Account No.
31260110058982, Hasanpur Branch, Lakhisarai for depositing the said amount. Hence, the informant is not opposing the prayer for bail of the petitioner.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 21 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
In the meantime, both sides file a joint application to the effect that issue has been resolved between the parties, before the learned court below, whereupon the learned court below will conclude the proceedings expeditiously
