2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 313, 317(5), 3(5) of the B.N.S.
3. The allegation in the FIR is that upon being apprehended, one Gokul Kumar divulged the name of this petitioner and one co-accused, Aman Kumar to have indulged in the incident of mobile snatching.
4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in this case only on the basis of the confessional statement of the apprehended co-
Patna High Court CR. MISC. No.62443 of 2025(2) dt.12-09-2025 2/3 accused Gokul Kumar, and besides the same, there is no other material to connect the petitioner with the offence. It is further submitted that the motorcycle in question is also said to be belonging to co-accused Aman Kumar and not to the present petitioner and the co-accused Aman Kumar has already been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 01.08.2025 passed in Cr. Misc. No. 46535 of 2025.
5. Learned APP for the State, however, opposes the prayer for anticipatory bail.

Taking into consideration the facts and circumstances of the case and also considering that the name of the petitioner has surfaced on the confessional statement of the co-accused, which has no evidentiary value and further considering that the similarly situated co-accused has already been granted the privilege of anticipatory bail, let the petitioner, above named, who has no criminal antecedent, in the event of his arrest or surrender before the Court below within four weeks, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Bypass
Patna High Court CR. MISC. No.62443 of 2025(2) dt.12-09-2025 3/3 P.S. Case No. 523 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023 with further conditions that:
(i) One of the bailors would be a family member or close relative of the petitioner.
(ii) Petitioners would fully cooperate with the Investigating Officer/Agency in the investigation of the present case and always be available for any questioning by the Investigating Officer/Agency as and when required.
