2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Barhara P.S. Case no. 476 of 2022 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 427, 379, 504 and 506 of the Indian Penal Code.
3. As per allegation in the FIR, on 29.6.2022, while the informant was coming from Bakhorapur by motorcycle, and reached near Keshopur bridge, 8-10 boys including the petitioner started mar-pit with the informant. It is further alleged that accused Prem Kumar Singh assaulted to Vinay Rai by means of Rarsha on his head. Accused Shivam Singh assaulted to Vishvakarma Rai by iron rod on his head and Ajit Singh and

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Allegedly, petitioner and accused Amit Singh have assaulted to Bhushan Rai, by means of lathi on his head and nose due to which blood started oozing out but his injury report suggests that injured Bhushan Rai has not sustained any injury on his head. He has received pain and swelling in left lower limb and bruise on nose and doctor opined the nature of injury as simple. Petitioner is a student and he has been falsely implicated in this case.
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and considering the nature of injury sustained by injured Bhushan Rai, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Barhara P.S. Case no. 476 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara
