JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 As prayed, the petitioner is permitted to make necessary correction in paragraph 3 of the bail petition in course of the day. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 272, 273, 120 (B) of the Indian Penal Code and Section 30 of Bihar Liquor Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 2690 liters of country made liquor were recovered from two places and a person, who was apprehended on spot, had disclosed the name of the petitioner in his confessional statement. There is no recovery from the possession of the petitioner. It is urged that he is in custody since 13.05.2017. The petitioner claims that his antecedent is
Patna High Court Cr.Misc. No.31896 of 2017 (2) dt.13-07-2017 2/2 clean.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram in connection with Nokha P.S. Case No.70/2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
