2. This is the second attempt of the petitioner for grant of regular bail in connection with Yogapatti (Nawalpur) P.S. Case No. 676 of 2022 registered for the offence under Sections 399, 402, 413, 414 and 212 of the Indian Penal Code and under Sections 25(1-B)A, 26, 35 of the Arms Act.

3. As per the prosecution case, the police got informant that the criminals had looted the bank and they were fleeing on Yogapatti Nawalpur Road. While looking for the criminals, one Raja Kumar was arrested from whom one loaded country made pistol and two live cartridges were recovered. A motorcycle was also recovered from Raja Kumar. Another police team came and they recognized the petitioner as one of

Patna High Court CR. MISC. No.68699 of 2024(5) dt.18-04-2025 2/3 the dacoits who had committed the crime in the State Bank of India wearing a Jacket which was identified by the police party. Finally, Raja Kumar accepted his guilt that he along with the other named criminals were involved in the dacoity and the criminals were hiding in the house of one Sarpanch from where Rs. 2,42,880/- has been recovered.

4. The petitioner is in custody since 19.02.2023.

5. In the trial only one witnesses has been examined in the trial.

6. Considering the facts and circumstances of this case and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran/concerned Court below in connection with Yogapatti P.S. Case No. 676 of 2022.

8. As a condition of this order, the petitioner shall appear in the trial regularly either virtually or through his lawyer and shall cooperate in the trial.

9. The petitioner after grant of bail will stay at the

Patna High Court CR. MISC. No.68699 of 2024(5) dt.18-04-2025 3/3 following address- "At Village-Nautar Jungal, P.S.-Gethihawa, P.S.- Hanumanganj, District-Kushinagar, PIN-274802, Uttar Pradesh. "

10. The petitioner will mark his attendance at the Hanumanganj Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.

11. The petitioner will visit Bihar only on the date fixed in the present case as well as in other cases in which he is an accused and is required to visit the Court. Before leaving Uttar Pradesh, the petitioner will inform the local police station about the case and the date and the period for which he is going to stay in Bihar to attend the cases.

12. Let a copy of this order be communicated to the Superintendent of Police, Kushinagar through FAX for its compliance.
