ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.07.2019 in connection with K. Nagar P.S. Case No. 262 of 2019 (Special Excise Case No. 538 of 2019), registered for the offence under Sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not made from his conscious possession and petitioner has been falsely implicated in connection with the present case. It is further submitted that the petitioner is not having any criminal antecedent.

Considering the aforementioned facts and
