Case diary was called for in the present matter which has since been received.
The petitioner is apprehending his arrest in connection with Supaul P.S.Case No. 370 of 2014 registered under Sectins 147, 148, 149, 323, 341, 324, 325, 379, 380, 302 and 504 of the Indian Penal Code.
Learned counsel for the petitioner submits that the main allegation is against one Md. Idrish, son of Md. Shabdul Mian, whereas the petitioner Md. Idrish made accused at serial No. 17 in the FIR is the son of Abdul Rahim. This fact has also been recognized by the father of the informant in paragraph-31 of the
Patna High Court Cr.Misc. No.21449 of 2015 (3) dt.29-09-2015 case diary.
Learned counsel appearing on behalf of the State after perusing the case diary submits that save and except the general allegation as made out in the FIR there is no further material in the case diary so as to implicate the petitioner. Considering the aforementioned facts and circumstances and the material available in the case diary, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Supaul P.S.Case No. 370 of 2014 to the satisfaction of the Chief Judicial Magistrate, Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
