1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352, 351(2) of the B.N.S., 2023.
3. Learned counsel for the petitioners submits that petitioner no.1 has antecedent of three cases, petitioner no.2 has antecedent of four cases and petitioner no.3 has antecedent of one case but then all cases are under Excise Act. It is further submitted that once an accused is implicated in a case relating to

It is next submitted that informant alleges that Ravindra was supplying liquor to retailer near his house, accordingly informant along with his brother Birendra objected, on which Ravindra abused and threatened, further called the named accused persons including the petitioners who came variously armed, thereafter Ravindra assaulted Birendra by rod causing injury on head, thereafter all accused assaulted his brother, while informant was trying to seek help from his family members and neighbours, thereafter Anand and Chandan both sons of his brother came and along with the informant tried to save Birendra, but Abhay assaulted Anand by farsha causing injury on head and Amarjeet assaulted Anand by butt of pistol while Himanshu and Ritik assaulted by lathi and Indrajeet snatched his chain worth Rs.60,000/-.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that Chandi P.S. Case No.106/2025 was instituted by wife of Ravindra alleging that Chandan and Birendra assaulted Ravindra by an iron rod on head causing injury i.e. the aforesaid case was instituted from the side of the petitioners. It is next submitted that no doubt
Patna High Court CR. MISC. No.63631 of 2025(2) dt.18-09-2025 3/3 injury of Anand on head has been opined to be grievous but then Abhay is alleged to have assaulted him by farsha. It is next submitted that there is no specific allegation against the petitioners of assaulting the side of the informant rather allegation against them is general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Chandi P.S. Case No.105/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
