JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with Bhargama PS case No. 200/2014 for the offence under section 395/397 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the informant and some other cattle traders along with their men were going from Bishanpur Bahadur to Lofa cattle market Madhubani by vehicle No. BR 11 M/5572 on the way some miscreants looted their cash and mobiles on the point of fire arms. On behalf of the petitioner, it has been submitted that the petitioner is not named in the first information report nor he has any criminal antecedent and his name appeared in course of investigation.

Patna High Court Cr.Misc. No.23606 of 2015 (2) dt.06-07-2015 2/2 On behalf of the State, it has been submitted that petitioner's name has come in course of investigation and there is sufficient material against him for his implication in the present case.

Considering the aforesaid facts and circumstance, I am not inclined to allow anticipatory bail to the petitioner. The prayer is rejected.

If the petitioner, above named, surrenders before learned Chief Judicial Magistrate, Araria within a period of four weeks from today in Bhargama PS case No. 200/2014 and prays for regular bail, the court below shall pass order considering the merit of the case, without being prejudiced by this order.
