JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 506 and 504/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that when the wife of the informant was cutting grass then accused persons abused her and on protest being made, the informant was assaulted and abused by calling caste name.
It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled and the informant has subsequently retracted from his initial version and
Patna High Court Cr.Misc. No.21975 of 2015 (2) dt.24-06-2015 2/2 filed a petition to that effect before the learned court below. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Saurbazar P.S. Case No. 59 of 2013 pending in the court of learned CJM, Saharsa. Accordingly, the application is disposed of.
