1. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Paliganj P.S. Case No. 406 of 2022, registered for offences punishable under sections 457, 380 and 411 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 14.09.2022 at about 1:00 A.M. when the informant was sleeping, she heard some sound and found that 4-5 persons had entered her house to commit theft, on alarm, all the miscreants succeeded in fleeing away except one who was apprehended and disclosed his name as Ravi Bhushan @ Niraj Sharma, it is next alleged that the accused persons committed theft of a gold chain, a silver bowl and other precious articles.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.64895 of 2025(2) dt.10-10-2025 2/2 petitioner was not arrested at the spot, as such nothing was recovered from his possession and his name transpired in the confessional statement of co-accused, which does not have any evidentiary value. It is also submitted that Guddu Kumar @ Guddu Halwai @ Shankar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.48438/2023 and the same was allowed by an order dated 25.08.2023 passed by a learned coordinate Bench.
5. Learned APP opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Danapur (Patna) in connection with Paliganj P.S. Case No. 406 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
