Heard the learned counsel for the petitioner as well as Mr. Dilip Kumar No. 1, the learned Additional Public Prosecutor for the State through video conferencing. The petitioner apprehends his arrest in connection with Roh P.S. Case No. 45 of 2017 registered for offence punishable under sections 420, 467 and 468 of the Indian Penal Code. As per allegation, the petitioner appeared twice in Board Examination, firstly in the year 1992 and secondly in the year 2010.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.1272 of 2022(2) dt.05-08-2022 2/2 that as a matter of fact, the name of the petitioner is Amit Ranjan. The petitioner appeared in the Board Examination in 1992, whereas one Santosh Kumar appeared in the Board Examination in 2010 and the result of Santosh Kumar has already been cancelled by the Board.

Considering the above-mentioned facts and circumstances, especially the fact that the result has already been cancelled by the Board, let the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nawada in connection with Roh P.S. Case No. 45 of 2017, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
