The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341/323/324/307/504/34 of the Indian Penal Code. Prosecution case is that the petitioners assaulted the informant with sharp cut weapon.
It is submitted by learned counsel for the petitioners that for the occurrence of 29.11.2015 at 10.30 AM, the FIR was registered on 29.11.2015 at 4.30 PM when the police station is only one kilometer away from the place of occurrence. The informant has received multiple sharp cut injury simple in nature. Moreover, the informant has retracted from initial version and has
Patna High Court Cr.Misc. No.19852 of 2016 (3) dt.12-05-2016 2/2 filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, preferably on the same day, if the petitioners surrender within a period of six weeks in connection with Araria P.S. Case No.588/2015, pending before the learned CJM, Araria .
With the above observation, this application is, accordingly, disposed off.
