2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(c) and 21(c) of the NDPS Act.

3. The case of the prosecution is that as per the case of the prosecution three persons were going on a bike. On being intercepted by police, two managed to escape. One Vivek was apprehended and from whose possession one kg. Brown sugar was recovered. The said co-accused Vivek disclosed that it was the petitioner who had given him the brown sugar for sell.

4. Learned counsel for the petitioner has submitted that from possession of this petitioner nothing has been recovered. Recovery if any has been made from the possession of Vivek and the name of this petitioner has surfaced only in the

Patna High Court CR. MISC. No.61913 of 2025(2) dt.09-09-2025 2/2 statement of Vivek. It has also been submitted that Mannu Kumar whose name has also surfaced in the statement of Vivek has been granted bail by the learned Co-ordinate Bench vide Cr. Misc. Case No. 48234 of 2023 dated 11.10.2023. The case of this petitioner stands on similar footing. The petitioner is a man of clean antecedent and is in judicial custody since 01.04.2025.

5. Learned APP for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gaya Mufassil P.S. Case No. 497 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge NDPS Act, Gaya.
