The petitioner is apprehending arrest in a case registered for the offences punishable under sections 414 of the Indian Penal Code and sections 11(1)(a),11(1)(d) and 11(1)(k) of Prevention of Cruelty to Animal Act.
The prosecution case is that three persons were found carrying animals to Nepal when 9 animals were seized but the petitioner and others managed to escape from the scene. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. It is further submitted that actually no recovery has been made from the possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Purushotampur P.S. Case No. 5 of 2016 pending in the court of learned ACJM IV, Bettiah, West Champaran. The bail application of the petitioner may be disposed of preferably on the same day.
This application is disposed of with the aforesaid observation/direction.
