The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution, it is a case of robbery, along with other co-accused persons in the shop of informant and taken away gold and silver ornaments total value of Rs. 4,00,000/- and cash of Rs. 2,000/-.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confessional statement of the co-accused Rajesh Sahni. Petitioner is not put on T.I.P. parade and nothing incriminating articles were recovered from the conscious possession of the
Patna High Court CR. MISC. No.62079 of 2022(2) dt.09-02-2023 2/2 petitioner. Petitioner is in custody since 07.06.2022. Learned APP appearing for the State has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mahua P.S. Case No. 379/2020, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
