The petitioner wants to renew his prayer for pre-arrest bail which has already been rejected by order dated 05.01.2015 vide Cr. Misc. No. 24872 of 2014 on the ground that the petitioner is not the assailant and other co-accused have been allowed bail and the matter has been compromised, to which the learned A.P.P. opposes.
Considering that against the petitioner also there is specific allegation of causing injury with garasa and as such this Court is not inclined to reconsider the prayer for pre-arrest bail of the petitioner and again his such prayer is hereby refused in connection with Sessions Trial No. 285 of 2014 arising out of Guthuni P.S. Case No. 44 of 2014 pending in the court of
Patna High Court Cr.Misc. No.25292 of 2015 (2) dt.24-06-2015 2/2 Additional District & Sessions Judge-V, Siwan. But in case and if so advised the petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on the same day without being prejudiced by this order and further considering that the matter has been compromised.
