The petitioners apprehend their arrest in Karakat P.S. Case No.64 of 2019 registered under Sections 341, 323, 307, 452, 504, 34 of the Indian Penal Code.

The informant named the petitioners along with Manohar Kumar, Raushan Kumar, Rohit Kumar, Gorakh Kumar and alleged that they all entered into his house and started looting articles. The accused assaulted the informant, Balkeshwar Singh on his head.

The learned counsel for the petitioners submits that on the same day, Karakat P.S. Case No.62 of 2019 was registered on the basis of the fardbeyan of Prince Kumar. Prince Kumar alleged that Balkeshwar Singh, informant of the present case,

Patna High Court CR. MISC. No.59325 of 2019(2) dt.24-09-2019 2/2 and others abused and assaulted him while he was singing Holi song. The case has been compromised and the informant got simple injury.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioners and the fact that prior to institution of the present case, from the side of the petitioners, Prince Kumar lodged the case in which he alleged that informant of the present case and others assaulted him, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Rohtas at Sasaram in connection with Karakat P.S. Case No.64 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
