JUSTICE ALOK KUMAR SINHA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 01-09-2025 In the instant petition, petitioner has prayed for the following relief(s):- "(i) To issue an appropriate writ / order / direction, in the nature of certiorari for quashing the Order dated 12.01.2018 passed by the Engineer-inChief -Cum-Additional Commissioner Cum Special Secretary, Building Construction Department, Bihar, Patna as contained in Memo No. 432 dated 15.01.2018 by which in purported exercise of power he has been pleased to Blacklist the Petitioner for one year under Rule 11 (Ka) (v) of the Bihar Contractors Registration Rules, 2007 (hereinafter referred to as "the 2007 Rules").

(ii) To issue an appropriate writ/order/ direction, in the nature of mandamus commanding the Respondents to issue Work Order of first floor Interior

Patna High Court CWJC No.2308 of 2018(4) dt.01-09-2025 2/2 Works and construction of second floor at Visheshwariya Bhawan Annexe Building, Patna, the Work Tender for which was issued vide NIT No.30/ के०भ० प्र०/16-17 for which the Petitioner was declared to be L-1 Tenderer vide Decision dated 19.06.2017 of the Departmental Tender Committee.

(iii) To any other relief or reliefs for which the Petitioner is entitled to."

2. Perusal of the dates and events, it is evident that as on this day blacklisting for one year has already spent its force, therefore, nothing remains in the present petition. Accordingly, the present CWJC No. 2308 of 2018 stands disposed of as it has become infructuous. If the petitioner has any other grouse insofar as return of EMD and other issues are concerned, he is at liberty to invoke remedy before appropriate authority. (P. B.
