Petitioners apprehend arrest in a case registered for offence punishable under sections and other ancillary sections 302, 201/34 of the Indian Penal Code.

As per the prosecution case, a dead body of one Ramdeo Mandal was found hanging on a mango tree for which U.D. Case bearing Laukahi, P.S. U.D. Case was registered. After investigation FIR was lodged.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. It is further

Patna High Court CR. MISC. No.2110 of 2022(3) dt.05-09-2022 2/2 submitted that due to land dispute between family members of the deceased and the petitioners this false case has been filed. There is no eye witness of the occurrence and on suspicion because of land dispute petitioners have been roped in the case. Petitioners claims clean antecedent.

Learned counsel for the State opposes the prayer for bail and submits that during investigation number of witnesses have stated that these petitioners and other accused persons have killed the deceased. Petitioner No. 2 and one Usha Devi have been seen by the family members of the deceased taking away the deeds of land from the house of the deceased. In view of the nature of allegation, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
