Versus

3. The District Land Acquisition Officer, Bhojpur at Ara
4. The Deputy Collector, Bhojpur at Ara .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : None For the Respondent/s : Mr. Shashi Shekhar Pd.Sinha, AC to GA 13 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 18-12-2015 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition, though the names of the learned counsel appearing on his behalf are printed in the daily cause list.
Learned AC to GA 13, appearing on behalf of the respondents, on the other hand, by referring to the averments made in the counter affidavit filed on behalf of the respondent nos. 2 to 4, submits that since the petitioner had voluntarily given the lands for National Highway and since payment of compensation has already been made; therefore, cause of action does not survive and the writ petition is liable to be dismissed.
Be that as it may, since none is appearing on behalf of the petitioner, the writ petition stands dismissed for want of prosecution.
