Petitioner seeks regular bail in connection with Samastipur Rail (G.R.P.) P.S. Case No.01 of 2014 registered for the alleged offences under Section 379 of the Indian Penal Code. As per the prosecution case, some articles of the informant were stolen by some unknown miscreants at Samstipur Railway Station.

It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. No incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. There is nothing on record barring the confessional statement of co-accused Amit Kumar who is said

Patna High Court Cr.Misc. No.29462 of 2017 (02) dt.01-07-2017 2/2 to have sold the stolen mobile to the petitioner. The petitioner is not named in the F.I.R. Petitioner has been named in four other cases but in all those cases he is on bail. He has been languishing in jail custody since 16.01.2017.

In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. (Railway), Samastipur in connection with Samastipur Rail (G.R.P.) P.S. Case No.01 of 2014.
