The petitioner seeks bail in connection with Falka (Pothia) P.S. Case No. 296 of 2020 lodged under Sections 147, 148, 149, 323, 302,504 and 506 of the Indian Penal Code read with Section 27 of Arms Act.

The specific allegation is the F.I.R. against this petitioner is that he has made Farsa blow on the head of Akhilesh Mandal. The injury report is annexed as annexure-2 at page 15 of this petition. There are two injuries indicated on the body of Akhilesh Mandal but simple in nature. The learned counsel also submits that the co-accused persons have granted bail by this Hon'ble Court vide order dated 27.05.2021 passed in Cr. Misc. No. 2252 of 2021 and order

Patna High Court CR. MISC. No.1599 of 2022(2) dt.06-06-2022 2/2 dated 27.07.2021 passed in Cr. Misc. No. 13541 of 2021. The petitioner is in custody since 08.09.2021.

Upon considering the argument and after perusal the record of this case, that allegation upon petitioner is to attack on the head of Akhilesh Mandal but injuries are simple in nature and also considering the period of custody, I am inclined to grant bail to this petitioner on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Falka (Pothia) P.S. Case No. 296 of 2020.
