This is an application for bail in connection with Dhangai P.S.Case No. 07 of 2017 registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
Allegation against the petitioner is of assaulting the deceased causing his death.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and there is no eye-witness to the occurrence and no specific allegation is attributed to the petitioner and he is in custody for five months. Heard learned APP and learned counsel for the informant also. They have opposed the prayer for bail.
Patna High Court Cr.Misc. No.29270 of 2017 (3) dt.24-07-2017 2/2 Having heard both sides and in view of the facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
However, petitioner may renew his prayer for bail after framing of charge in this case.
Accordingly, this application is dismissed.
