Petitioners apprehend their arrest in connection with a case registered under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
Allegation in brief is that all accused persons intercepted the informant on way and started assaulting indiscriminately when other family members came for his rescue they were also assaulted by the accused persons. It is submitted that there is case and counter case between both sides and there is injury to petitioners' side also and there exists land dispute between them.

No.28974 of 2017 (2) dt.13-07-2017 2/2 However, the injury sustained by Pawan Yadav on the head is grievous in nature, so petitioners do not deserve prearrest bail accordingly prayer for anticipatory bail of the petitioners, namely, Jai Prakash Yadav, Mithlesh Yadav and Akhilesh Yadav @ Aklesh Kumar Yadav in connection with Banmankhi P.S. Case No.35 of 2017 pending in the court of Sri Krishna Gopal, A.C.J.M. 6th, Purnea is rejected. However, if they surrender and seek regular bail the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) N.H./- U T
