2. The petitioner has moved the Court seeking pre-arrest bail in connection with Mashrakh PS Case No. 51 of 2016 dated 08.02.2016 instituted under Sections 420, 467, 468, 406 and 471 of the Indian Penal Code.

3. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the application with liberty to surrender before the Court below and seek bail.

4. In view thereof, as prayed for by learned counsel for the petitioner, the application stands disposed off as withdrawn with liberty aforesaid.

5. In case, the petitioner surrenders and prays for bail before the Court below within four weeks from today, the same shall be considered on its own merits, without being prejudiced by the present order. It shall be open to the petitioner to canvass all points available to him, including the fact that the amount in question has been returned to the persons from whom it is said to have been taken.
