The petitioner seeks bail in connection with Phulwarisharif P. S. Case No. 669 of 2018 dated 30.08.2018 instituted for the offences under Section 302 and 34 of the Indian Penal Code.
The petitioner along with five others is said to have snatched the mobile phone of the informant and also assaulted him. The deceased died because of the assault perpetrated by him.
Learned counsel for the petitioner has submitted that even though five persons are said to have assaulted the
Patna High Court CR. MISC. No.58375 of 2019(4) dt.20-11-2019 2/2 deceased but he has suffered only three injuries. Apart from this, it has been urged that some of the accused persons in this case having similar allegation against them have been granted bail by Coordinate Benches of this Court. Taking into account the aforesaid facts and the period of custody of the petitioner which is from 20.10.2018, the petition is allowed.
The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge XV, Patna in connection with Phulwarisharif P. S. Case No. 669 of 2018.
