JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

As per the prosecution case, this petitioner and two other accused persons committed rape on 13 years old daughter of the informant.

Learned counsel for the petitioner submits that the petitioner along with his family members have falsely been implicated in this case as the petitioner opposed the decision of the panchayat to marry her. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent. Considering the statement of the victim recorded u/s 164 of the Cr.P.C., prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
