Petitioners being parents and brother of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A, 325, 341, 323, 504, 379, 34 of the Indian Penal Code. It is alleged that informant was being tortured and when the father and brother of the informant went to her in-laws house to meet and pacify the issue then they were also assaulted by lathi, danda and spade.
The injury reports of the father and brother of the informant have been brought on record by way of supplementary affidavit. The injury report of the father of the informant suggests that doctor found no visible injury whereas the doctor has found one defused swelling on forehead and one
Patna High Court Cr.Misc. No.23064 of 2015 (2) dt.14-07-2015 2/2 lacerated injury on right hand of the brother of the informant. Considering the fact that thrust of accusation is against the husband of the informant and the nature of injury, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad in connection with Jehanabad(Mahila) P.S. Case No. 21 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
