Petitioner, apprehending his arrest in Barh P.S. Case No. 206 of 2015 registered under Sections 147, 148, 149, 307, 387 of the Indian Penal Code and Section 27 of the Arms Act, seeks anticipatory bail.
As soon as the informant and the injured crossed the river to go to the field, it is alleged that all the accused persons including the petitioner started indiscriminate firing. Specific allegation is that the fire shot by the petitioner and one Bipul hit the victim Sujeet Paswan in his abdomen causing injury.
Contention of the petitioner is that some of the witnesses during investigation have stated that the fire shot by Bipul hit the injured. Parties are on inimical terms as a case was earlier lodged
Patna High Court Cr.Misc. No.17423 of 2016 (2) dt.10-05-2016 2/2 against the present prosecution side.
Learned APP, opposing the case, submits that specific allegation is attributed to the petitioner. The petitioner has also criminal antecedents some of which have been cited in paragraph 3 of the bail petition.
Considering the allegation and the background of the petitioner, I am not persuaded to extend the privilege of anticipatory bail to the petitioner.
Prayer is, accordingly, rejected.
