JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-03-2023 The present writ petition has been filed seeking the following relief:- "1. That the present writ petition is being filed for issuance of a writ in the nature of a writ of mandamus for a direction / directions to the respondents to remove the encroachment from the petitioner's land and to maintain peace & tranquility in the area also while allowing to construct the Taziya Chowk as per 'Sulahnama' created and accepted since 5 decades and for further order/orders, relief/ reliefs for which in the facts and circumstances of the case the petitioner may entitle to."

Patna High Court CWJC No.22345 of 2013(3) dt.17-03-2023 2/2 At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Sheohar for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Sheohar by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, for removal of encroachment made over public land, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
