NILU AGRAWAL ORAL ORDER 03-10-2017 Heard learned counsel for the petitioner, learned counsel for the complainant/informant and learned A.P.P. for the State.

The petitioner is languishing in jail since 01.06.2017 in a case registered for the offences punishable under Sections 498 (A), 406, 323 of the Indian Penal Code and under Section 4 of Dowry Prohibition Act.

The prosecution case as lodged by the

Patna High Court Cr.Misc. No.29048 of 2017 (3) dt.03-10-2017 2/3 complainant is that due to non fulfillment of demand of dowry, she was subjected to mental and physical torture by the petitioner along with others. It is also alleged that accused persons took away her all ornaments worth Rs. 5, 00,000/- and left her at Rajpur Bazar.

It has been submitted by the learned counsel for the petitioner that he is innocent and ready to keep his wife with full dignity and honour and for that the matter was sent to Patna High Court Mediation and Conciliation Centre and the petitioner, who is in Military service, shown his willingness to keep his wife but the complainant is not ready to stay with the petitioner. However, learned counsel for the informant submits that she is ready to take maintenance but not ready to stay with the petitioner and submits that she has been subjected to mental torture by the petitioner and her in-laws.

Learned A.P.P. for the State is present.

Considering the report of Mediation and

Patna High Court Cr.Misc. No.29048 of 2017 (3) dt.03-10-2017 3/3 Conciliation Centre, Patna High Court, the provisional bail of the petitioner granted by this Court under order dated 01.07.2017, is hereby confirmed.
