The petitioners apprehend their arrest in a case registered under Section 7 of the E.C. Act.
The informant has alleged that when on telephonic information, he reached at the place, he found that two Pick-up vans loaded with food grains were caught by the villagers. It is also alleged that the petitioners were owner and driver of the said vehicles.
It has been submitted on behalf of the petitioners that the petitioner no.1 is the owner and petitioner no.2 is the driver of the vehicle and they have no concern with the alleged seized article. It is submitted that the petitioners were only to transport the said article to its destination. Further it is submitted that the petitioner has no criminal antecedent.
On behalf of the State, it has been submitted that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.24496 of 2015 (2) dt.14-07-2015 2/2 petitioners, named above, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sri P. Dutta, Judicial Magistrate, Ist Class, Kishanganj in connection with Pothia P.S.Case No.135 of 2014, (G.R.No.967/2014), subject to conditions as laid down under section 438(2) of the Cr.P.C.
