JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 324, 326 and 302/34 of the Indian Penal Code.

Allegation is that altogether 13 accused including the petitioner had assaulted the informant's husband to death. It has been submitted on behalf of the petitioner that she has got no criminal antecedent. It is submitted that petitioner is a lady and altogether 13 persons have been named in the F.I.R. with general and omnibus allegations. No specific injury has been attributed against the petitioner. It is further submitted that vide Annexure-2 a separate case has been instituted for the same offence where it is alleged that there was a theft of buffalow and in that deceased was killed.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.24821 of 2015 (3) dt.16-09-2015 2 / 2 petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate cum Addl. M, Bikramganj,. Rohtas , in connection with Kachhawa P.S. Case no. 42 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
