2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and Section 25 (1-B) a, 26, 27 and 35 of the Arms Act.

3. The case of the prosecution is that the police received secret information that certain miscreants were planning to commit an offence. Acting upon the said information, the police conducted a raid during which three persons were apprehended while two others managed to escape. It is further alleged that apprehended persons disclosed the names of the escaped persons which included the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the physical possession of the petitioner. His name has surfaced on the basis of the confessional statement of the co-accused persons, who were apprehended on the spot. It is further submitted that the petitioner have eight criminal antecedents. Moreover, the petitioner is languishing in judicial custody since 15.03.2025.

5. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with S.T. No. 130 of 2025 arising out of Gwaplara P.S. Case No. 118 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge -IX, Madhepura.
