JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
It is specifically alleged that co-accused Wazir Dewan assaulted with farsa on the head of the informant causing cut injury and when the informant fail down then he was assaulted by accused persons with lathi. It is also alleged that Mukhtar Dewan
Patna High Court Cr.Misc. No.25558 of 2015 (2) dt.01-07-2015 2/2 resorted to fire where as petitioner no.1 took `1,000/- from the pocket of the informant and petitioner Jahangir Dewan snatched the bicycle.
It is submitted by learned counsel for the petitioners that the petitioners are the agnates of the informant and due to land dispute, accusation has been levelled. The specific accusation is against Wazir Dewan who is not petitioner in the present proceeding whereas the informant has received only one incised simple injury.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari in connection with Turkauliya P.S. Case No. 767 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
