Petitioner seeks bail in a case registered under sections 399, 402, 411, 420, 120B of the Indian Penal Code as well as various sections of the Arms Act.

Neither petitioner was caught on the spot nor anything was recovered from his conscious possession and alleged recovery is said to be made by a vehicle and admittedly, petitioner is owner of the aforesaid vehicle.

Submission on behalf of the petitioner is that no stolen article or firearm was recovered from the vehicle of the petitioner. Moreover, even if any stolen article is said to have been recovered from the vehicle of the petitioner at the time of alleged occurrence, aforesaid vehicle was being driven by driver of the vehicle. Petitioner is in jail custody since 4.1.2016 and does not have

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Buniyadganj P.S. Case no. 08/2014.
