JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 101 of 2016, registered for offences punishable under Sections 304B/34 of Indian Penal Code. Allegation against the petitioner is causing dowry death of the deceased.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and admittedly the marriage was solemnized before seven years and as such Section 304B/34 will not apply. Further no specific allegation has been attributed to the petitioner and he has been in judicial custody since 06.08.2016.
Learned counsel for the State opposed the prayer for bail.
Patna High Court Cr.Misc. No.30808 of 2017 (3) dt.25-07-2017 Having heard both sides, considering the fact and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the commitment of the case and after commitment try to conclude the trial of the petitioner as early as possible, preferably within a period of nine months.
