JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,342,323,324,353,337,427,307,188,504,506,109 and 115 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that on recovery of dead body lying near the railway track adjacent to Guraru railway station, the police was taking the dead body to Magadh Medical Hospital for post mortem when mob attacked the police force and made assault as a result three constables received injuries. It is submitted by the learned counsel for the petitioner that the accusation is against the mob and the mob was protesting against the inaction of the police. The police in order to save its

Patna High Court Cr.Misc. No.18811 of 2016 (2) dt.03-05-2016 own skin lodged the present case. Similarly situated co accused has been granted anticipatory bail vide Cr. Misc. No. 9565 of 2016. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Guraru P.S. Case No. 78 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
