JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State.

The petitioner is in custody in a case registered under Sections 379/411/34 of the Indian Penal Code. The prosecution case, in brief, relates to theft of the tempo of the informant during the night of 16.03.2015 while the informant was sleeping after parking his tempo in his house. The petitioner was apprehended by the villagers though some of his associates were managed to escape. The petitioner was taken to P.S. and on the basis of information provided by the informant Bodh Gaya P.S. Case No. 83 of 2015 was instituted.

It is submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2015 and charge sheet

Patna High Court Cr.Misc. No.25116 of 2015 (2) dt.21-07-2015 has been submitted in the case. It is also submitted that the petitioner has got no criminal antecedents. It is further submitted that due to petty reasons, the present prosecution has been instituted against the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.S. Case No. 83 of 2015.
