The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147/149/341/323/342/353/307/379/504 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the accused persons pelted stones during immersion of Goddesses Saraswati and abused the informant by calling caste name.
It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also. Moreover, the
Patna High Court Cr.Misc. No.26824 of 2015 (2) dt.21-07-2015 2/2 informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-3 to the petition. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Hussainganj P.S. Case No.47 of 2014, pending before the learned Chief Judicial Magistrate, Siwan.
With the above observation, this application is, accordingly, disposed off.
