The petitioner has preferred this application for grant of regular bail in a case registered under sections 21(a) and 23(A) of the NDPS Act.

As per the prosecution case, on the petitioner being confronted and checked it transpired that large quantity of Nitravate 10 tablets were recovered from his possession for which he had no document.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 20.9.2021 and undertakes to abide by all the conditions which may be laid down for his release on bail. Heard learned APP for the State.

No.1444 of 2022(3) dt.06-01-2023 2/2 Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for more than a year since 20.9.2021 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sonbarsa P.S. Case no. 267 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Sitamarhi on the condition that both bailors of the petitioner shall be resident of a place within the jurisdiction of the learned trial Court.
